The descriptions of goods and services included in this web site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we become aware of them. However, this web site could include technical inaccuracies or typographical errors. You should also be aware that the colors and appearance of images may vary very slightly from the way they appear on the screen. Changes are periodically added to the information herein; these changes will be incorporated in new editions of the publication.

INTERFERENCE WITH OUR SERVICE

You may not use any device, software, or routine to interfere or attempt to interfere with the proper working of the Gallery X site or any transaction being conducted on our site. You may not take any action that imposes an unreasonable or disproportionately large load on our system.

Users may not attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for the user, logging into a server or account the user is not expressly authorized to access, or probing the security of other.

Users may not attempt to interfere with service to any user, host, or network. This includes, but is not limited to, "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" the Service.

Sale of Artwork, Products and/or Services

MAKING A CONTRACT WITH GALLERY X

Orders placed by Users through the Site for the purchase of Artwork, Products and/or Services shall be deemed to constitute an offer by the User (also referred to herein as “Purchaser”) to enter into a contract with Gallery X ("Gallery X") on these Terms and Conditions, which offer shall be accepted by Gallery X by shipping the order.

PAYMENT

Payment of the Purchase Price specified on the Site Order Page for each Artwork, Product and/or Service selected by Purchaser, and any applicable delivery/shipping costs, or other expenses of any kind or nature, including but not limited to sales tax, customs duties, artist resale royalties, export or import charges (collectively “Shipping and/or Other Expenses”), is due in full by an acceptable credit card at the time of shipment.

                                             

Gallery X and Purchaser agree that the sale of Artwork and/or other Products and the transfer of title in the Artwork, Products and/or Services from the Artist to Purchaser shall take place only after the Purchaser has paid the Purchase Price and Shipping and/or Other Expenses in full as provided herein, and the Purchaser takes actual possession of the Artwork, Products and/or Services. At such time as title passes to Purchaser, risk of loss will also pass to Purchaser, and if the Artwork and/or other Product are damaged in transit, Purchaser should contact Gallery X immediately at: enquiries@galleryx.co.uk, for further instructions on how to proceed.

 

ORDERING & SHIPPING

Gallery X accepts a number of debit and credit cards as payment – for further information please see our 'ordering' page, or contact us at: enquiries@galleryx.co.uk. On the completion of an order the work will be dispatched by us and at our expense.

 

Gallery X will, on receipt of the Purchase Price and any applicable Shipping and/or Other Expenses, arrange for delivery of the Artwork and/or Product to the Purchaser via common carrier at the address specified on the Site Order Page. Gallery X will pack and insure the Artwork and/or Product for at least the full Purchase Price and name Gallery X as the insured party.

ARTWORK DESCRIPTION

Sales of all Artwork, Products and/or Services are governed by these Terms and Conditions, as well as any detailed exceptions as included in individual Artwork, Product and/or Service descriptions on the website. While Gallery X is committed to providing excellent customer service, Purchasers must note that, due to their inherent characteristics, Artwork(s) may require additional handling or other considerations as stated in an Artwork’s description page that may modify these Terms and Conditions. These considerations may or may not include a restocking fee to be borne by the Purchaser for Artwork(s) and/or other Product(s) returned to Gallery X that requires special shipment.


RETURNS POLICY

Due to the nature in which each artwork is created to order negates the standard remote trading laws as published by the DTI. Therefore, the standard 7 day cooling off period in which you may return goods for a full refund without reason is not applicable.

The Purchaser may, however, return, at the Customers' expense initially, an Artwork and/or other Product, if it has arrived in a damaged condition. The Purchaser is responsible for checking the condition of the goods on arrival and should refuse delivery if there is any sign of intrusive damage to the packaging. Gallery X cannot be held responsible for the Purchaser accepting delivery from the carrier goods that are obviously damaged. The Purchaser should report damaged goods firstly to the delivery agent then to Gallery X using this e-mail address: enquiries@galleryx.co.uk After 48 hrs following delivery of the Artwork and/or other Product, all sales are final and no returns due to damage can be accepted.

All returns are to be made directly to Gallery X once prior approval and a returns number has been issued. Upon successful reciept of the returned goods we will re-inburse your carriage costs.

Custom-made or commissioned Artwork:
All sales of custom made or commissioned artworks are final. Purchaser’s credit card will be charged at the time an order is placed and no refunds or returns will be permitted or accepted.

AVAILABILITY

In the event an Artwork and/or other Product is unavailable for any reason, the Purchaser may, at his or her option, obtain (1) a full refund of any amounts paid to Gallery X or, (2) a full credit for amounts paid applicable to the purchase of any other Artwork and/or other Product(s) available at that time.

REMEDY FOR PURCHASERS FAILIURE

If any of the Terms and Conditions herein are not complied with in a timely manner by the Purchaser, in addition to other remedies available to Gallery X by law, including without limitation the right to hold Purchaser liable for the Purchase Price, Gallery X may hold the Purchaser liable for any and all costs of collection, reoffer, handling charges, commission, and any legal fees and expenses attributable to Buyer’s breach of the Terms and Conditions.

ARTIST'S COPYRIGHTS

The Artist reserves all rights protected under international copyright laws in all Artwork purchased by the Purchaser. The sale of a given Artwork does not include any assignment, transfer or license to Purchaser of the right to reproduce, modify or create derivative works of any Artwork, unless such right is expressly granted in writing by the Artist.

CORRECTIONS

The descriptions of goods and services included in this web site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should be aware that the colors and appearance of images may vary very slightly from the way they appear on the screen. iF COLOUR IS CRITICAL PLEASE ASK US FOR A SWATCH BEFORE MAKING YOUR PURCHASE. We regret that any subsequent purchase made without such provision will not be refundable.

 

CHANGES TO THIS AGREEMENT

Gallery X reserves the right to change the terms of this agreement when it is deemed necessary, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without notice.
